Article 1 - Our commitments

For the purposes of the Data Protection Legislation (as defined below), mesence shall be considered as the controller of your Personal Data. mesence hereby undertakes to treat any and all information provided online by a user as strictly confidential.

Article 2 - Applicable law

All personal data collected and/or processed via the Website is done in accordance with EU Regulation 2016/679 (GDPR), without prejudice to other applicable national consumer legislation.

Article 3 - Who collects and processes Your Personal Data, how and for which purposes?

3.1.mesence may collect and process your Personal Data for a variety of different purposes.

3.2.For commercial purposes to provide the e-commerce services you subscribed to or reserved for registered users, notably to fulfill orders that you have placed for goods or services through the Website, to contact you in relation to any issues with your order or where we need to provide your Personal Data to our service providers in relation to your orders of products and more generally anything related to our commercial relationship (herein the "Commercial Purposes"). MESENCE shall be considered as the controller of your Personal Data collected and processed on the Website for Commercial Purposes, as it determines the purposes and means of processing Personal Data for such Commercial Purposes.

3.3.For marketing purposes, notably to send to users, also through newsletter, commercial communications, information and updates on our products, offers, promotional campaigns and on events and similar initiatives. MESENCE shall be considered as the controller of your Personal Data collected and processed on the Website for Commercial Purposes, as it determines the purposes and means of processing Personal Data for such Marketing purposes.

3.4.The Processors of your Personal Data for the above-mentioned purposes are:

- mesence’s Customer service, for purposes related to the shipping, delivery and return of products purchased on the Website and customer service to users of the Website;

- Computerservices, for purposes related to hosting mesence’s servers;

- Payment platforms, for purposes related to the payment method and its execution;

- Logistic services, for purposes related to shipping and delivery and return of the products purchased on the Website.

- Marketingservices, for the analysis of use of our Website, sending communications, managing advertising content, etc.

3.5.Your Personal Data is mostly processed by electronic means. Your Personal Data shall be stored in a way which allows us to identify you for the period necessary for the purposes which the data was collected for and subsequently processed and, in any case, in accordance with Data Protection Legislation.Your Personal Data shall not be disclosed to third-parties other than us for purposes which are not permitted by law or without your consent.

Article 4 - On which legal basis are your personal data processed?

4.1.The processing of your Personal Data is justified on different grounds (legal basis) depending on the use that mesence makes of the Personal Data.

4.2.In some cases, mesence asks for your consent in order to process your Personal Data. However, in certain circumstances, Data Protection Legislation allows us to process your Personal Data without the need to obtain your consent.

4.3. The processing of your personal data is based on:

- for Commercial purposes the legal basis is a Contract. The retetion period is 5 years  from date of order

- for Marketing  purposes the legal basis is consent. the retention period is 3 years from the last activity

- for Exercise of  data rights the legal basis is law. the retention period is 5 years from day of request.

Article 5 - What if you do not provide your data?

For some services (such as placing an order), it is necessary to provide your personal data. If you refuse to do so, we will not be able to process your order or request. Failure to provide optional data will not affect your use of the Website.

Article 6  - Who will your data be shared with?

6.1.Third parties that provide services on behalf of MESENCE (processors);

6.2.In all cases, this is done in accordance with the law. Your data will not be shared with other parties without your knowledge.

Article 7 - Security measures and retention period

7.1.We take appropriate technical and organisational measures to protect your data against loss, destruction, unauthorised access or use.

7.2.We only retain your data for as long as necessary for the purpose for which itwas collected. After that, it is deleted.

7.3.Please also ensure that your device and internet connection are secure (e.g.antivirus software, firewall, etc.).

Article 8 - Transfer of data outside the EU

Your data is currently stored within the EU. In the future, it may be transferred outside the EU. In that case, we will ensure that appropriate protective measures (such as contractual clauses) are in place so that your data is processed securely in accordance with European standards.
