Article 1 - Definitions
- Agreement: The distance contract concluded between MESENCE and the Customer for the purchase of Products via the Website. The Agreement is governed by these general terms and conditions.
- MESENCE: MESENCE, incorporated under the laws of Belgium, with registered office at Ninoofse Steenweg 84, 1080 Molenbeek, Belgium, registered under company number1019.834.145 and VAT number BE1019834145.
- Customer: Any natural person acting for purposes outside their trade, business, craft or profession who purchases or may purchase Products via the Website.
- Products: The jewellery and related goods offered for sale on the Website.
- Website: www.mesence.com
Article 2 - Applicability
- These general terms and conditions apply to all offers, orders and Agreements concluded via the Website.
- By placing an order, the Customer expressly agrees to these general terms and conditions.
- These terms are made available electronically and can be saved or printed by the Customer.
Article 3 –Conclusion of the Agreement
3.1. The Agreement is concluded when the Customer places an order via the Website and receives an order confirmation by e-mail.
3.2. MESENCE reserves the right to refuse or cancel an order in case of manifest errors, incorrect pricing, fraud, force majeure or unavailability of a Product.
Article 4 - Prices
- MESENCE applies the VAT exemption scheme for small enterprises in accordance with Article 56bis of the Belgian VAT Code. Asa result, VAT is not charged on the Products.
- Shipping costs are clearly indicated before the order is finalised.
- If a Product is listed at an incorrect price, MESENCE will inform the Customer. The Customer may either accept the corrected price or cancel the order without cost.
Article 5 - Payment
- Payment must be made at the time of ordering using one of the payment methods offered on the Website.
- Orders are only processed once full payment has been received.
- If payment is not received or is reversed, MESENCE reserves the right to cancel the order automatically.
Article 6 - Shipping
6.1.Processing Time
-Orders are processed within 1–4 business days.
-Custom-made pieces are made to order and typically require 3–6 weeks,depending on the piece.
-For specific timing questions, the Customer may contact MESENCE at contact@mesence.com.
6.2. DeliveryTime
- Once dispatched, delivery within Belgiumusually takes 1–6 business days.
- Delivery times are indicative and may vary due to courier services orcircumstances beyond MESENCE’s control.
-All shipments within Belgium are free of charge.
6.3. ShippingArea
MESENCE currently ships within Belgium only.
Article 7 - Delivery
- Products are delivered to the address provided by the Customer during the order process.
- The Customer must inspect the Products upon delivery and report any visible damage or defects without delay to contact@mesence.com.
- Products remain at MESENCE’s risk until they are delivered to the Customer or to a third party designated by the Customer. In case of loss or damage during shipment, MESENCE will provide an appropriate solution in accordance with applicable consumer law.
Article 8 - Right of Withdrawal & Returns
8.1. In-stockProducts
- In-stock Products may be returned within 14days of delivery, in accordance with EU consumer law.
- Returned Products must be: unworn and unused (trying on jewellery is allowed); returned in their original, undamaged packaging, including all accompanying materials.
- If a Product or its packaging shows signs of wear or damage, MESENCE reserves the right to withhold all or part of the refund to reflect the loss in value.
- A return label will be provided. A flat return shipping fee of €15will be deducted from the refund.
- Once the return has been received and inspected, approved refunds will be issued to the original payment method.
- Refunds may take up to 7 business days, depending on the bank or payment provider.
8.2.Custom-made Products
- Custom-made or personalised Products are non-returnable.
- If a custom-made Product arrives damaged, the Customer must contact MESENCE at contact@mesence.com within 3 days of delivery, so an appropriate solution can be found.
Article 9 - Warranty
- The Customer benefits from the legal warranty of2 years for conformity defects.
- Defects must be reported by e-mail within 2 months of discovery.
- If the warranty applies, MESENCE will repair or replace the Product, or offera refund if repair or replacement is not possible.
- Normal wear, misuse, accidental damage or damage caused by the Customer is excluded from warranty.
Article 10 - Complaints
- Complaints can be submitted to contact@mesence.com.
- Complaints will be handled within 14 days of receipt.

Article 11 - Personal Data
MESENCE processes personal data in accordance with its Privacy Policy, available on the Website.
Article 12 - Force Majeure
MESENCE is not liable for delays or non-performance due to force majeure. In such cases, obligations are suspended for the duration of the force majeure event or the Agreement may be terminated.
Article 13 - Applicable Law
These general terms and all Agreements are governed exclusively by Belgian law.
Article 14 - Miscellaneous
- If any provision is held invalid or unenforceable, the remaining provisions remain fully in force.
- MESENCE’s liability is limited to the value of the ordered Products.
